1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and LiveWorth ("we," "our," or "us") governing your use of the LiveWorth mobile application (the "App") and the website at liveworth.app (the "Website"), collectively referred to as the "Service."

By creating an account or using the Service, you represent that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms.

2. Description of Service

LiveWorth is a personal finance application that allows users to manually track their net worth by entering assets and liabilities. The App provides features including:

• Manual entry and tracking of assets and liabilities
• Live market price tracking for stocks, ETFs, mutual funds, and cryptocurrencies
• Multi-currency support with live foreign exchange rates
• Historical net worth charts and snapshots
• Automatic amortization calculations for loans and mortgages

LiveWorth does not provide financial advice, investment recommendations, or tax guidance. The App is a tracking and visualization tool only.

3. Accounts and Registration

To use the App, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not create an account for anyone other than yourself, create multiple accounts, or use another person's account without their permission.

4. Subscriptions and Payments

4.1 Free and Pro Tiers

LiveWorth offers a free tier with limited features and a paid "Pro" subscription with additional features. Details of what is included in each tier are described in the App and on our Website.

4.2 Billing

LiveWorth Pro subscriptions are billed through the Apple App Store. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. Prices are in the currency of your App Store account and may vary by region.

4.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your Apple ID account settings.

4.4 Free Trials

We may offer free trial periods for LiveWorth Pro. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Any unused portion of a free trial will be forfeited if you purchase a subscription before the trial ends.

4.5 Refunds

All purchases are processed by the Apple App Store. Refund requests must be made through Apple in accordance with their refund policies. We do not process refunds directly.

5. User Content and Data

5.1 Your Data

You retain ownership of all financial data you enter into the App. We do not claim any ownership rights over your content. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.

5.2 Accuracy of Data

You are solely responsible for the accuracy of the financial data you enter. LiveWorth does not verify the accuracy of user-entered data. The net worth calculations, charts, and other outputs are based entirely on the data you provide and the market prices we retrieve.

5.3 Data Deletion

You may request deletion of your account and all associated data at any time through the App's Settings or by contacting us at support@liveworth.app.

6. Market Data and Financial Information

6.1 No Financial Advice

LiveWorth is not a financial advisor, broker, or investment service. The App is a personal tracking tool. Nothing in the App constitutes financial advice, investment advice, tax advice, or a recommendation to buy, sell, or hold any security or asset. Always consult a qualified financial professional before making financial decisions.

6.2 Market Data Accuracy

Live market prices are obtained from third-party data providers. While we strive to provide accurate and timely data, we do not guarantee the accuracy, completeness, or timeliness of any market data. Prices may be delayed, incomplete, or inaccurate. Do not rely on LiveWorth for trading decisions.

6.3 Currency Conversion

Foreign exchange rates are approximate and obtained from third-party sources. Converted values are estimates and may differ from actual exchange rates offered by banks or brokers.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the Service or its servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit malware, viruses, or harmful code
• Scrape, mine, or extract data from the Service through automated means
• Resell, sublicense, or redistribute the Service or any data obtained from it
• Use the Service on behalf of a third party without our prior written consent

8. Intellectual Property

The LiveWorth name, logo, App design, Website design, and all related content, features, and functionality are owned by LiveWorth and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without our prior written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any information obtained through the Service, including market data, currency conversions, and amortization calculations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIVEWORTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty Canadian dollars (CAD $50), whichever is greater.

You acknowledge that financial tracking involves inherent risks and that LiveWorth is not responsible for any financial decisions you make based on information displayed in the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless LiveWorth and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by deleting your account through the App's Settings or by contacting us.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 9, 10, 11, and 14.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service and delete your account.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of the Province of Ontario, Canada.

15. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and LiveWorth, not Apple. LiveWorth, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
• You must comply with any applicable third-party terms of agreement when using the App.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LiveWorth regarding the Service, and supersede all prior agreements and understandings.
